教育部長吳思華堅持對闖入教育部的反課綱學生提告，民進黨26日再以立法院長王金平在318學運時不對學生提告、承諾修法、讓學運和平落幕為例，告訴吳思華「有前例可循」，呼籲對學生和記者撤告。

民進黨發言人、律師黃帝穎26日舉例指出，去年318學運結束後，立法院不但未對進入議場的學生提告，院長王金平更在學運期間親自探視學生，承諾兩岸協議監督條例》立法前，不會召集朝野協商《服貿協議》，呼應學生「先立法再審查」的訴求，最終讓學運和平退場。

黃帝穎表示，教育部有立院拒絕控告學生的前例可循，吳思華不該是「忍痛」提告，而是要「理智」撤告。他說，《刑法》第306條「侵入住居罪」、第354條「毀損罪」，都屬於告訴乃論，只要機關首長吳思華不提出告訴，案件便無法進入偵辦、甚至是審理程序。

黃帝穎強調，學生進入教育部並非為了私人利益，而是為了教育合法性的公共利益，而課綱爭議焦點就是政府強推程序違法、內容錯誤的課綱教材，造成社會動盪。

黃帝穎呼籲，吳思華應依法撤回課綱，並參考立院拒告學生前例，對學生和記者撤告，勿站在民主對立面，留下「部長告學生」的歷史罵名。
